B <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: February 8, 2006 <br />TOPIC: Final Plat, Marshan Meadows <br />BACKGROUND <br />The City Council approved the preliminary plat for Marshan Meadows on May 9, 2005 <br />with Resolution 05 -61. Marshan Meadows is a 20 -lot residential development on Lake <br />Drive. <br />The approval of the preliminary plat included a condition for a conservation easement <br />along the lake. The proximity of a nesting area for a rare species, the Forsters' tern, <br />makes it important to protect the wetlands and the lake. This bird has been documented <br />as nesting in wetlands in the Marshan Lake area. The conservation easement coincides <br />with our standard drainage and utility easement over wetlands. We are working with the <br />developer on the terms of the easement. These will include such things as signs along the <br />easement edge and prohibiting mowing and dumping of grass clippings or fill. <br />The final plat itself is consistent with the approved preliminary plat. The City Attorney is <br />reviewing the title commitment. The City Engineer has prepared the development <br />agreement. These and the conservation easement will be completed prior to city council <br />consideration. <br />OPTIONS <br />1. Approve the final plat for Marshan Meadows. <br />2.
