• <br />Subd 11 <br />Subd 12 <br />Subd 13 <br />Subd 14 <br />Kennel, private. Any parcel of property on which more than two (2) dogs <br />over six (6) months of age are kept for private enjoyment and not for <br />monetary gain. Every kennel shall be enclosed or fenced in such a manner as <br />to prevent the running at large or escape of animals confined therein. <br />Private Kennels shall be allowed in all zoning districts upon parcels of <br />property five (5) acres or more in size following issuance of a Conditional <br />Use Permit. <br />Owner. Any person, firm, corporation, organization, or department, <br />possessing, harboring, keeping, having an interest in, or having temporary or <br />permanent custody or control of an animal. <br />Under Restraint. Controlled by a leash of not more than six (6) feet in <br />length; under restraint by an electrical device, i.e. electric fence provided the <br />animal is wearing a shock collar made for that specific electrical device; or <br />within the limits of its owner's premises in any residential district; under the <br />voice or signal command of a competent person whose command the animal <br />will obey immediately in other zoning districts. <br />An unattended dog on the property of another, without the consent of such <br />property owner, is "at large" and not under restraint, even though it might be <br />on a leash. <br />502.2 Enforcement Personnel: <br />Subd 1 Enforcement. <br />A The provisions of this Section may be enforced by any of the following: <br />(1) The primary law enforcement agency of the community. <br />(2) The animal control officer as designated by the City. <br />(3) The animal control facility contracted with by the City. <br />B For the purpose of discharging the duties imposed by this chapter and to <br />enforce its provisions, any animal control officer or any police officer is <br />empowered to enter upon any premise upon which any domestic or non - <br />domestic animal is kept and to demand the exhibition of such animal by the <br />owner of such animal and the license and rabies certificate for such animal. <br />Any police officer may enter the premises where any animal is kept in a <br />reportedly cruel or inhumane manner and demand to examine such animal <br />and to take possession of such animal when, in such officer's opinion, the <br />animal's life is in danger. <br />Page 3 <br />
