Planning & Zoning Board <br />March 8, 2006 <br />Page 8 <br />Mr. Fagerland stated that when traffic studies were done, a drive - through use was not <br />included, therefore he would like another traffic study. <br />Mr. Rafferty expressed that he does not think this issue merits an additional traffic study. <br />He pointed out that the majority of traffic will be in the morning, which is not much <br />different from that of a daycare, in regards to a traffic study. He stated that all of the <br />points made tonight were very clear and good comments. He concluded that the Board <br />needs to focus on a recommendation based on information before them tonight. <br />Mr. Hilger requested a condition to decrease the radius of the turn exiting the drive - <br />through. He added that the board could include a condition to increase architectural <br />review. Mr. Hilger requested that the proposal remain as one vote, as the issues are <br />linked by design. <br />Mr. Pogalz made a Motion to close the Public Hearing at 9:48 p.m., and was supported <br />by Mr. Hyden. Motion carried 6 -0. <br />There were no further questions for staff. <br />Mr. Root made a Motion to Recommend Approval of a Conditional Use Permit for <br />outdoor seating with Conditions 1 -4, 6, 8 & 9, removing Conditions 5 & 7, and adding <br />Condition 10, designating a crosswalk connecting the sidewalk that goes East -West from <br />Lakota Trail to the front of the building, and adding Condition 11, adding architectural <br />pylasters. Motion was supported by Mr. Laden. <br />Mr. Nelson commented that he would prefer to vote for both issues at once as they were <br />presented as a whole. <br />Mr. Pogalz agreed and questioned why the issues had been separated. Mr. Root <br />responded that he likes the outdoor seating but does not like the drive - through. <br />The Board requested confirmation that if the existing motion were to fail, would they be <br />able to then vote on both components together. Staff replied yes. <br />Motion failed 3 -4. (Hyden, Nelson, Pogalz and Rafferty voting nay.) <br />Mr. Pogalz made a Motion to Recommend Approval of a Conditional Use Permit to <br />allow for an accessory drive - through and outdoor seating facilities for Miller's <br />Crossroads Shopping Center with Conditions 1 -9, adding Condition 10, requiring a <br />striped crosswalk through the drive - through area, and adding Condition 11, that the <br />radius out of the drive - through area to the parking lot exiting area be reviewed with staff. <br />Motion was supported by Mr. Hyden. <br />Mr. Rafferty noted that he is opposed to free standing trash enclosures. <br />Motion carried 5 -2.
