PUBLIC HEARING for a Conditional Use Permit for a Private Dog Kennel at <br />575 Ash Street <br />• <br />• <br />Mr. Bengtson presented the staff report, noting that the applicant currently has three dogs <br />and is proposing to keep those existing dogs on the premise. Mr. Bengtson explained that <br />the city had received three phone calls regarding the public hearing notice, but only one <br />resident continued to voice concern after clarification that the applicant would only have <br />three dogs. Staff recommended approval of the application subject to the conditions <br />listed in the staff report. <br />Vice Chair Pogalz opened the Public Hearing at 6:46. <br />Margo Polta, 575 Ash Street, applicant was present for questions. <br />Mr. Laden made a Motion to close the Public Hearing at 6:49. Motion was supported by <br />Mr. Rafferty. Motion carried 5 -0. <br />Mr. Laden made a MOTION to approve the Conditional Use Permit to allow a Private <br />Dog Kennel at 575 Ash Street subject to the following conditions: <br />a. The proposed development application has been found to be consistent with the <br />policies and recommendations of the Lino Lakes Comprehensive Plan. <br />b. The proposed development application is compatible with present and future land <br />uses of the area. <br />c. The proposed development application conforms to performance standards herein <br />and other applicable City Codes. <br />d. Traffic generated by a proposed development application is within the capabilities <br />of the City. <br />c. Will not involve uses, activities, processes, materials, equipment and conditions <br />of operation that will be detrimental to any persons, property, or the general <br />welfare because of excessive production of traffic, noise, smoke, fumes, glare, or <br />odors. <br />f. Will not result in th <br />feature of major importance. <br />1. Ongoing compliance with Sections 502 and 503 and 607 of the City Code. <br />2. At no time shall dogs that are not owned by the occupant of the dwelling be allowed <br />to remain on the property overnight. <br />3. A maximum of three dogs over the age of six months shall be kept on the property at <br />any one time. <br />4. All animals kept on the property shall be licensed in accordance with city policies. <br />5. Failure to comply with any of the conditions of this conditional use permit shall <br />constitute grounds for revocation of the license of such kennel. <br />DRAFT MINUTES <br />
