• <br />AGENDA ITEM V.0 <br />STAFF ORIGINATOR: Paul Bengtson <br />P & Z MEETING DATE: October 11, 2006 <br />TOPIC: Planned Unit Development - Final Plan <br />Legacy Townhomes Second Addition <br />BACKGROUND <br />Hartford Group Inc. has applied for a Planned Unit Development final plan for a portion of the townhome <br />property within the Legacy at Wood's Edge project located on the southeast quadrant of Interstate 35W and <br />Lake Drive. <br />ANALYSIS <br />Building Plans <br />410\ typical final plan application consists of the building plans for the units and the final plat of a portion of the <br />townhome property. However, this is the second phase of the project and therefore the building plans approved <br />for the first phase will be continued in this part of the project. This will clearly be included within the <br />development agreement for the site. <br />Final Plat <br />The final plat for the second addition is substantially conforming to that shown during the first addition, the <br />only difference being the dedication of a drainage and utility easement over the entirety of the lots surrounding <br />the townhomes. This is a cleaner process for defining the easements and was suggested by staff prior to <br />application. The applicant is vacating the drainage and utility easements recorded on Outlot B of the Village <br />No. 3 plat, which will go through a first reading at the November 13th City Council meeting and will then have a <br />second reading prior to this item on the November 27th City Council. <br />RECOMMENDATION <br />Staff recommends approval of the project, subject to the following conditions: <br />1. The developer will enter into a development agreement with the city prior to the issuance of any <br />building permits for the site. This agreement shall clearly require that the conditions of Resolution <br />06 -119 still apply to this site. <br />2. The vacation of drainage and utility easements on Outlot B of Village No. 3 must be approved and <br />recorded prior to this final plat being recorded. <br />ATTACHMENTS <br />1. Legacy Townhome Final Plat received September 11, 2006. <br />
