Section 2 Subds. 1. — 9. DRAFT AMENDMENTS May 2011 <br />1-514. No applioation for oaf use permit shalt be resubmitted -for a <br />period-affie{ -1.2 -} sf- said-erder -of denial. <br />When a motion to deny the application is successful, the application shall <br />not be resubmitted for a period of twelve (12) months from the date of the <br />denial vote. However, as required by MN Stat 15.99 Subd. 2(b), the <br />failure of a motion to approve the application does not preclude an <br />immediate submission of the same or similar application. <br />*option: Just eliminate the, waiting period by deleting paragraph J <br />altogether. <br />C. Revocation. The City Council may take action to revoke a conditional <br />use •ermit when it is in the interests of •ublic health safet or welfare. <br />1. The City Council may take action to revoke a conditional use permit <br />in any of the following situations: <br />a. Construction has not begun within one (1) year after the date <br />of the conditional use permit. <br />b. Substantial construction has not taken place within three (3) <br />years after the date of issuance of the conditional use permit. <br />c. If, for any reason, the authorized use ceases for more than one <br />(1) year. <br />d. If an approved conditional use permit is in violation of this <br />Ordinance or the conditions of permit approval,., <br />2. When the City may initiates a process to revoke the conditional use <br />permit 4- e City it shall conduct a public hearing to consider <br />the revocation of a - use -exit. Notifications shall be <br />distributed and published according to paragraph B.3. The public <br />hearing shall be conducted by the Planning & Zoning Board, which <br />shall make a recommendation to the City Council. In considering <br />revocation, the Board and the City Council shall consider compliance <br />with the approved conditions of the conditional use permit and the <br />standards listed in paragraph B.7.
