• <br />FINAL PLAT CONDITIONS CHECKLIST <br />"Preserve at Lino Lakes" <br />1 <br />CONDITIONS TO BE MET PRIOR TO COUNCIL APPROVAL OF FINAL PLAT <br />Compliance <br />Yes <br />No <br />MMUNITY DEVELOPMENT DEPARTMENT <br />1. <br />One (1) electronic copy in a format compatible with the City's computer system shall <br />be submitted. <br />a. Final plat <br />b. Site Plans <br />10 <br />2. <br />A revised Conservation Easement, Covenants & Restrictions (CECR) shall be <br />submitted in recordable format which includes the following: <br />a. Conservation Easement survey map and legal description shall be attached as <br />Exhibit A and B. <br />b. Description of the restoration and management plan, its funding and <br />implementation. <br />c. Definition of the easement document <br />d. Definition of The Preserve Conservation Development Restoration and <br />Management Plan for Conservation Areas <br />e. Attachment with the easement legal description and figure (as prepared by <br />MFRA) <br />f. Definition of "Conservation Area" must include Outlots C and D as well as B, <br />E, F <br />g. Must establish the fund for implementing the management plan and specify <br />the assessment amount for the fund <br />h. Describe when the assessment will be submitted to the City <br />i. Statement that the Declarant (developer) is responsible for the management <br />fund payments for lots owned by the Declarant. (Without this, the fund will <br />not grow in the first few years and there will not be funds available for <br />implementation.) <br />j. A statement that any provision of the Declaration regarding the conservation <br />easement or implementation of the management plan cannot be amended <br />without the permission of the City <br />k. We recommend a `conflicts among documents' statement like in the other <br />documents <br />3. <br />Homeowners Association documents shall be submitted. <br />a. A homeowners association shall be created. <br />b. Association documents shall describe the restoration and management plan, its <br />funding, and its implementation. <br />c. The association shall be responsible for and shall maintain a stewardship fund <br />to implement the restoration and management plan for the open space areas <br />defined by the conservation easement. <br />d. The stewardship activity shall be in accordance with the conservation <br />easement and the approved restoration and management plan. <br />e. The Bylaws must include the following: <br />1 <br />
