Our understanding of the situation is that you have entered in to a <br />purchase agreement to sell the southern lot, recently split, for the purposes of new home construction <br />by the buyer. <br />After reviewing the proposal against RCWD Rules, it appears that a RCWD permit will not be required for <br />this activity. Based on the limited building envelope that is determined by municipal setbacks, <br />construction must be limited to the point where it will not threaten wetland or floodplain areas on the <br />site. Appropriate soil erosion and sediment controls must, of course, be employed during construction <br />to protect these areas. Also, new impervious surface on the site cannot exceed 10,000 square feet. The <br />new owner should notify the RCWD of their intent to construct a new home once a final grading plan is <br />developed. The RCWD would like to confirm at that time that no floodplain or wetland fill will take <br />place. The 100 -year regulatory flood elevation on the property is 887.0 feet (NAVD 88 datum).
