20 <br />4. A rural subdivision can demonstrate that each lot can be served by an adequate sanitary • <br />sewer disposal system; and <br />5. A rural subdivision with a proposed communal sanitary sewer or water system has an <br />effective long range management and maintenance program with proper financing. <br />(Ord. 04 -03, passed 2 -24 -2003) <br />§ 1001.014 MUSA ALLOCATION. <br />(note: this entire section will be deleted upon adoption of the new comp plan because we will no longer <br />have a MUSA reserve that is separate from the growth staging areas.) <br />(1) MUSA availability and commitment. <br />(a) The city shall determine MUSA availability as part of the review of a submitted preliminary <br />plat/phasing plan. <br />(b) City approval of the plan shall constitute a commitment by the city to allocate MUSA at the <br />time of final plat approval according to the phasing plan. <br />(c) The criteria in this section shall be considered in the review of the preliminary plat /phasing <br />plan. <br />(2) MUSA allocation criteria. The following criteria shall be considered to determine if MUSA will <br />be allocated to a preliminary plat/phasing plan: <br />(a) A finding is made that the development of the property is not premature; <br />(b) The existing or proposed zoning of the property is consistent with the proposed use; <br />(c) Development of the subdivision will meet environmental design standards of the Lino Lakes <br />Subdivision and Zoning Chapters; <br />(d) The allocation is applied only to net buildable acreage; <br />(e) A utility extension can be made to the subject property; <br />(f) A roadway extension can be made to the subject property; <br />Y J p p Y; <br />(g) Development of the property shall not adversely a f f <br />ect the health, welfare , and general safety <br />of the community; and <br />(h) The area of the MUSA allocation is consistent with the growth management policy <br />established by the Lino Lakes Comprehensive Plan. <br />(Ord. 04 -03, passed 2 -24 -2003) <br />DRAFT JANUARY 5, 2009 <br />• <br />• <br />
