• <br />• <br />AGENDA ITEM 5.B. <br />STAFF ORIGINATOR: Paul Bengtson <br />P & Z MEETING DATE: January 14, 2009 <br />TOPIC: PUBLIC HEARING: Zoning Ordinance Amendment <br />Amending the Definition of Private Kennel to allow <br />three dogs on any property without a kennel <br />license. <br />BACKGROUND <br />In response to concerned residents, the City Council adopted a new definition of <br />the term Private Kennel, which allows three dogs on any property instead of the <br />previous limit of two dogs. As this definition is repeated in the Zoning Ordinance <br />for the purposes of enforcing the need for Conditional Use Permits for <br />Commercial Kennels, the Planning and Zoning Board is now being asked to <br />consider an amendment to the Zoning Ordinance to match the definition of the <br />City Code as adopted by the City Council on January 12, 2009. <br />ANALYSIS <br />The definition of Private Kennel should reflect the following changes: <br />KENNEL, PRIVATE. Any structure or premises on which fi <br />be,�cweeen 3 <br />{three) and 4 (four) dogs, over six months of age, are kept for private <br />enjoyment and not for monetary gain. <br />PROCESS <br />As this amendment to the zoning ordinance originates with staff, there is no <br />applicant. However, an amendment to the ordinance requires a public hearing to <br />allow for public comment. A notice of the public hearing was published in the <br />official newspaper as required. Following a recommendation by the P & Z Board, <br />staff will present the proposed amendment to the City Council. An ordinance <br />requires two readings (and votes) by the City Council. Upon adoption, it then is <br />published in the newspaper and becomes effective after thirty days have passed. <br />RECOMMENDATION <br />Staff is recommending approval of the zoning ordinance amendment. <br />
