• <br />• <br />AGENDA ITEM V C <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE OF MEETING: April 12, 2000 <br />TOPIC: Minor Subdivision, Rick Carlson, 599 62nd Street (Junes <br />Property) and 607 62nd Street (Rehbein Property) <br />DESCRIPTION: <br />The property owners at 599 and 607 62nd Street are requesting a minor subdivision to <br />allow their homes to be split from the balance of their property which has been purchased <br />by Mr. Carlson and is intended for future development. The property is currently Zoned <br />Rural and guided for low density sewered residential in the Draft Comprehensive Plan. <br />In May of 1997 the City Council approved a minor subdivision for the Junes property at <br />599 62nd Street that split the parcel into three pieces. Parcel A was dedicated to the City <br />for Park as a part of the Miller's South Glen Plat with some park dedication credit for <br />future development. This park land was added to Birchwood Acres Park. Parcel B was <br />retained by the Junes and contains their existing homestead. Parcel C was retained by <br />Mr. Rick Carlson for future development. Following this action, Mr. Carlson secured a <br />purchase agreement with the Rehbeins at 607 62nd Street (Parcels E & F) and proceeded <br />to plat that property and the Junes Parcel C into West Shadow Ponds. That development <br />was approved by the Planning and Zoning Board and continued at the November 23rd, <br />1998 City Council meeting. Mr. Carlson subsequently requested a delay in Council <br />action which is still pending. <br />This minor subdivision request is intended to finalize purchase agreements between Mr. <br />Carlson and the Junes and Rehbeins. The resulting parcels, new C and F, would be <br />combined with the 1997 Parcel C and held for future development (West Shadow Ponds). <br />Parcels B and E would remain as existing homesteads as allowed within the Zoning <br />Ordinance, Section 3. Subd. 3., 2.b.2 which reads, in part: <br />"Habitable single family homes constructed prior to July 13, 1992 may reduce <br />their lot size to a minimum of one (1) acre if the balance of the property results in <br />a parcel of ten (10) acres, or is serviced by public sewer...." <br />Parcel B is 6.69 acres with a considerable amount of wetland. According to the <br />ordinance, parcels of property in the Rural zoning district must contain at least 20% <br />upland area. This parcel contains 1.29 acres of upland and 5.4 acres of wetland. We <br />believe the .04 acre shortage in upland is insignificant in this case. Parcel E contains 1 <br />acre with more than 20% upland. <br />
