In consideration of a rezone the Planning and Zoning Board shall consider possible <br />adverse effects of the proposed amendment. Its judgement shall be based upon, but not <br />limited to, the following factors: <br />1. The proposed action has been considered in relation to the specific <br />policies and provisions of and has been found to be consistent with the <br />official City Comprehensive Plan. <br />2. The proposed use is or will be compatible with present and future land <br />uses of the area. <br />3. The proposed use conformswith all performance standards contained <br />herein. <br />4. The proposed use can be accommodated with existing public services <br />and will not overburden the City's service capacity. <br />5. Traffic generation by the proposed use isvithin capabilities of streets <br />serving the property. <br />The City's EDAC reviewed this request unanimously recommended approval. Should <br />the P & Z determine that the requested rezone meets the above described criteria staff <br />would recommend the following conditions of approval: <br />1. The draft comprehensive land use maps are amended to reflect a commercial <br />designation for the newly created 4 acre parcel prior to adoption of the plan. <br />2. A minor subdivision is approved for the newly created 4 acre parcel and that <br />parcel is legally combined with the .68 acre parcel fronting on Lake Drive. <br />3. Development of the site is contingent upon adoption of the Comprehensive <br />Plan and allocation of MUSA. <br />Should the P & Z determine that a rezone of this parcel does not meet the above criteria, <br />staff would suggest the following Findings of Fact on a motion to deny the request. <br />Additionally, an application for rezone may not be resubmitted for 12 months unless all <br />reasons for denial have been satisfied or unless reconsidered by the City Council: <br />1. The proposed Rezone fails to meet criteria described above until such time as <br />the City's Comprehensive Plan is adopted, "1. The proposed action has been <br />considered in relation to the specific policies and provisions of and has been <br />found to be consistent with the official City Comprehensive Plan. <br />2. The proposed Rezone fails to meet criteria described above until such time as <br />a development plan is submitted and reviewed "5. Traffic generation by the <br />proposed use is within capabilities of streets serving the property." <br />• <br />• <br />• <br />
