• AGENDA ITEM 5G <br />• <br />• <br />STAFF ORIGINATOR: Jeff Smyser, Julie Farnham of TKDA <br />P & Z MEETING DATE: June 14, 2000 <br />TOPIC: <br />BACKGROUND <br />PUBLIC HEARING: Ordinance 09 -00 <br />Tree Preservation Ordinance <br />JU�vV�.�c7l�! <br />NvQ <br />Staff has been working with Julie Farnham of TKDA to prepare a new tree preservation <br />ordinance. <br />The new ordinance will do several things, including: <br />• Codify and clarify tree preservation requirements for private development in one <br />ordinance. <br />• Require a tree preservation plan and clearly describe the elements of such a plan. <br />• Establish a clearly defined tree replacement ratio. As the amount of tree loss <br />increases, the required percentage of replacement increases. This is an incentive to <br />minimize tree loss. <br />The attached material includes the text of the tree preservation requirements and a formal <br />Ordinance 09 -00. The text of the new tree preservation requirements will be inserted as <br />Article I of the formal ordinance. Article II gives the ordinance a shorthand name. <br />Article III voids a previous policy, and replaces it with the new ordinance. Article IV <br />clarifies that the 1990 Shade Tree Ordinance relates to City property while this new <br />ordinance covers private development. It also corrects a typo in the 1990 ordinance. <br />The Environmental Board discussed the new tree preservation requirements twice before <br />the May 10 P & Z discussion. After opening the public hearing and taking comment, the <br />P & Z can close the hearing or continue it if additional information is needed. The <br />ordinance will require a first and second reading by the City Council. <br />OPTIONS <br />1. Approve Ordinance 09 -00 and forward to City Council. <br />2.
