Development, Apollo Business <br />Center, Conditional Use Permit - Grading <br />BACKGROUND: <br />This project was originally considered by the Planning and Zoning Board on July 12, <br />2000, but the Public Hearing was continued. Since that time, the applicant has <br />submitted additional detail and revised plans for the City's consideration. <br />G.M. Development (Gary Uhde) is developing an area known as the Apollo Business <br />Center located east of Jon Avenue, between the 74th Street alignment and I -35W. Maps <br />showing this area are attached. Within this area; the Blue Heron and Contract Hardware <br />sites have been developed, the H & L Mesabi site plan has been approved for <br />development, and the Twin City Fab (parcel D) and Marmon /Keystone (parcel E) sites <br />have submitted site plans for review. <br />Trunk sanitary sewer and water provided service to this area of the City about 10 years <br />ago. Construction of Apollo Drive through this site was completed in 1992/93. Apollo <br />Drive was constructed through a Joint Powers Agreement with Anoka County and was <br />designed to comply with county and State Aid design standards. To accommodate <br />proper design of the storm sewer system, the roadway had to be raised above the <br />surrounding elevations. <br />In order to provide fill to be sold to the Apollo Drive contractor, borrow pits were created <br />in the Apollo Business Center. It was expected these pits would later be utilized as <br />storm water pond sites. In order to modify the location of the excavations, and to <br />provide fill for the proposed building sites on parcels D and E, the developer expects to <br />move in excess of 80,000 cubic yards of material. Section 12.B of the City's Zoning <br />Ordinance states 'When five thousand (5,000) or more cubic yards of material is to be <br />removed or deposited on any lot or parcel, a conditional use permit shall be required ". <br />The proposed grading plan includes fill, excavation, storm sewer construction, and <br />wetland alteration. Rice Creek Watershed District (RCWD) is the LGU in this part of the <br />City and has the responsibility for reviewing the proposed wetland alterations. The <br />RCWD has reviewed the proposed grading and wetland alteration and authorized permit <br />issuance upon completion of two items. City staff expects these conditions will be <br />satisfied by the applicant. <br />The Environmental Board minutes from May 31, 2000, are also attached for your review. <br />We recommend approval of the Conditional Use Permit with the following conditions: <br />1. A rock construction entrance must be included for erosion control. Location and a <br />detail are needed. <br />2. The permit must the acquired from the Rice Creek Watershed District. <br />
