• <br />• <br />• <br />AGENDA ITEM V A <br />STAFF ORIGINATOR: Mary Kay Wyland <br />MEETING DATE: Tuesday, February 13, 2001 <br />TOPIC: PUBLIC HEARING, Molin Concrete, 415 Lilac, Amended <br />Conditional Use Permit <br />DESCRIPTION: <br />Molin Concrete is located at 416 Lilac Street. The site is a concrete processing facility <br />that is permitted in the General Industrial Zoning District with a Conditional Use Permit. <br />They have been located in this area since 1971. Molin Concrete received an Amended <br />Conditional Use Permit and an Interim Use Permit in October of 1997 covering their <br />entire site and allowing the expansion of their facility including an interim use permit for <br />outside storage on the light industrial portion of the property. The conditions of approval <br />are attached for information purposes. <br />Since that approval in 1997, OSHA (Federal Occupational Safety & Health <br />Administration) rules have changed and Molin is prohibited from operating their <br />equipment without back -up beepers. They have therefore requested removal of condition <br />number 11.c. Strobe lights replace truck back -up beepers during nighttime hours (6:00 <br />p.m. to 8:00 a.m.). <br />The Council is aware of several complaints received from neighboring residences <br />concerning the back -up beepers (copies attached). We have also received a letter from an <br />adjoining property owner, Ms. Kathleen Schwartz, expressing concerns regarding the <br />industrial use (attached). These beepers frequently begin at 4:00 a.m. <br />Staff would suggest amending the previously approved Amended Conditional Use Permit <br />and Interim Use Permit by adding the following language: <br />1. Equipment requiring back -up beepers shall be prohibited from Light Industrial <br />portion of site, north of vacated 77th Street, between the hours of 6:00 p.m. and <br />8:00 a.m. <br />This condition would allow Molin to work in the general industrial portion of the site, but <br />not in the light industrial portion. The light industrial area adjacent to the residential <br />neighborhood is intended to buffer that neighborhood from the heavier industrial use to <br />the south. Again, Molin would still be allowed to work in the general industrial area of <br />the site with the amended condition although it may not eliminate the noise complaints. <br />
