Streets: Stage Coach Trail is already in place for the majority of the site and will be <br />connected fully with the Grandview project to the south. A sidewalk is shown on the east side of <br />the street within the right of way. This must be continued to the southern boundary of the plat. <br />Conservation Easement: A Conservation Easement was supplied by the developer for <br />Marshan Meadows and will govern the development of both of these lots. <br />Park Dedication: There is no land dedication needed, as Marshan Park is nearby, so the <br />typical park dedication fee will be collected with the Development Agreement. <br />Utilities: Sanitary sewer and water are located within Stage Coach Trail and both lots will <br />be required to connect. The drainage and utility easement indicated on the south property line of <br />Lot 2, Block 1 is depicted at 10 feet in width. This is in excess of what is needed for the city, <br />which is 5 feet in width. This reduction may allow the developer to shift garage footprint closer <br />to the property line thereby increasing the building area on the lot. This must be changed prior to <br />the city signing and releasing the final plat mylar for the project. <br />Grading: The grading plan has been reviewed by the City Engineer and his comments will <br />need to be addressed to his satisfaction prior to the site being developed. The grading plan does <br />acknowledge the Grandview project that was approved by the city earlier this year, and the <br />applicant is working with that developer to make sure that both projects grading work seamlessly <br />together. <br />RECOMMENDATION <br />Staff is recommending approval of the Preliminary and Final Plat request, subject to the <br />following conditions: <br />1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. <br />2. A development agreement between the city and the developer must be executed prior to the <br />issuance of any building permits for the site. <br />3. Park dedication must be paid in accordance with the city's fee schedule. <br />4. A conservation easement shall be granted over the drainage and utility easement within the <br />lots fronting Marshan Lake. Easement restrictions shall be defined prior to city council <br />approval of the final plat. <br />5. The Rice Creek Watershed District must review the project prior to building permits being <br />issued by the city for any new construction. <br />6. A boulevard tree shall be provided for each lot frontage. <br />7. The drainage and utility easement shown on the south property line of Lot 2, Block 1 shall be <br />reduced to 5 feet in width prior to the final plat mylar being signed and released by the city. <br />8. The signs for the conservation easement must be in place prior to the issuance of building <br />permits for either of the newly created lots. <br />This review is based on the following plans and information: <br />City Engineer Comments dated December 5, 2007 <br />Environmental Board Comments from November 28, 2007 <br />Marshan Meadows 2nd Plan Packet received November 9, 2007 <br />
