use, may be placed within the final WPC only on compelling need and <br />pursuant to the District's variance procedures. <br />(j) Unless a different standard is stated in the approved replacement or <br />banking plan, the performance standard for upland and wetland restored <br />or created to generate credit is the establishment, by the end of the WCA <br />monitoring period, of a medium or high plant community ranking <br />pursuant to the approved replacement plan and establishment of at least <br />50% of the total number of native species of an approved BWSR wetland <br />mix and 80% areal coverage proposed in the planting or seeding plan. <br />(k) A variance to a requirement of section 5 otherwise meeting the criteria <br />of District Rule L may be granted if the Technical Evaluation Panel <br />concurs that the wetland protection afforded will not be Tess than that <br />resulting from application of the standard criteria of the Wetland <br />Conservation Act. <br />6. WETLAND BANKING. <br />(a) Replacement requirements under Section 5 of this Rule may be <br />satisfied in whole or part by application of replacement credits generated <br />off -site within the RMP -3 area, but not by credits generated outside of <br />the RMP area. <br />(b) The deposit of replacement credits created within the RMP -3 area for <br />banking purposes and credit transactions for replacement will occur in <br />accordance with Minnesota Rules 8420.0740 and 8420.0760 as <br />amended.
