• <br />Agenda Item 6B <br />Staff Originator: Marty Asleson <br />Environmental Board Meeting Date: April 28, 2010 <br />Topic: Storm Water Ordinance Review and Comments <br />Background: <br />Under the "Non Point Discharge Elimination System (NPDES), Phase II ", all <br />Cities are considered a "Municipal Separate Storm Water Sewer <br />System "(MS4's), must address six minimum measures in required storm water <br />pollution prevention programs. Cities must develop Ordinances pertaining to the <br />responsibilities outlined in the Minimum control measures. A Storm water <br />Ordinance must address: <br />1. Implementation of proper erosion and sediment controls on sites over 1/2 <br />acre, <br />2. Requiring construction site operators to control erosion and sediment <br />3. Controls for chemicals, solid wastes and other wastes on construction <br />• 4. sites, <br />Procedures for site plan review of construction plans that consider <br />potential water quality impacts, <br />5. Procedures for the receipt and consideration of information submitted by <br />the public, <br />6. Sanctions to ensure compliance, <br />7. Illicit Discharge Detection and Elimination, <br />8. Implementation of post- construction runoff controls to the extent allowable <br />by state or local law. <br />• <br />In response to the MS4 requirements, City Staff have drafted the attached <br />Stormwater and Erosion and Sediment Control Ordinance (. The purposes <br />or objectives of the attached Ordinance are to: <br />1 Protect life and property from dangers associated with flooding, <br />2. Protect public and private property and the natural resources from <br />damage resulting from runoff and construction site erosion, <br />3. Ensure land development that minimizes the generation of stormwater <br />runoff volumes and peak rates and maximize pervious areas for <br />stormwater treatment, <br />4. Promote regional stormwater management by subwatershed, <br />5. Provide a single, consistent set of performance standards that apply to all <br />developments, <br />
