DRAFT 4 -28 -2010 <br />(9) Sustain or enhance biodiversity (native plant and animal habitat) and support riparian <br />• <br />ecosystems. <br />• <br />X.04 APPLICABILITY <br />This Ordinance requires that a Storm Water Management Permit or an Erosion Control <br />Permit be completed and submitted for review and approval by the City of Lino Lakes. <br />Applicants will complete either a SWPPP or an ESC, but not both, as described in Sections (1) <br />and (2). <br />(1) Storm Water Management - A Storm Water Management Permit, including a Storm <br />Water Pollution Plan (SWPPP), shall be required for all proposed land development activity, <br />unless otherwise exempted in this ordinance, which meets any or all of the following: <br />(a) Any land development activity that may ultimately disturb1.0 acre or greater of <br />land, including smaller individual sites that are part of a common plan of development <br />that may be constructed at different times; and /or single - family residential development <br />or redevelopment for a site 5.0 acres or greater; and/or <br />(b) Creation of more than 10,000 sq. ft. of impervious surface, including smaller <br />individual sites that are part of a common plan of development that may be constructed at <br />different times; and /or <br />(c) The site is within the 100 -year floodplain; within 1,000 feet of a public water or <br />protected wetland; impacts a wetland; and/or within 300 feet of Rice Creek, Clearwater <br />Creek, Hardwood Creek, or a public ditch; and /or <br />(d) If redevelopment will disturb fifty percent or more of existing impervious surface <br />or increase impervious surface by fifty percent or more; and/or <br />(e) Any land development activity, regardless of size, that the City determines would <br />otherwise cause an adverse impact to an environmentally sensitive area or other property. <br />(2) Erosion and Sediment Control - An Erosion and Sediment Control (ESC) Permit <br />including an Erosion and Sediment Control Plan shall be required for all proposed land <br />disturbing activity unless otherwise exempted in this ordinance that meets any or all of the <br />following: <br />(a) Includes excavation, filling, or stockpiling of erodible material in excess of <br />50 cubic yards; and /or <br />(b) Disturbs a total land surface area of 5,000 square feet or more; and /or <br />3 <br />
