• <br />• <br />• <br />AGENDA ITEM 5A <br />STAFF ORIGINATOR: Marty Asleson <br />MEETING DATE: June 30, 2010 <br />TOPIC: Illicit Discharge Ordinance <br />BACKGROUND: <br />A Proposed Storm Water Ordinance was reviewed by the Environmental Board <br />on April 28, 2010. In the reviewed document, section X.09 is titled Pollution <br />Prevention. Staff wishes to extract this section of the April 28, 2010 document <br />and create a stand -alone Ordinance for Illicit discharge. Illicit Discharge control <br />measures is one of the 6 minimum control measure requirements of operators of <br />a Phase II regulated small municipal separate storm water sewer system (MS4). <br />The City of Lino Lakes is an MS4. <br />Federal regulations define an illicit discharge as "any discharge to an MS4 that is <br />not composed entirely of stormwater". Illicit discharges are considered "illicit" <br />because MS4's are not designed to accept, process, or discharge such non - <br />stormwater- wastes. Required of MS4s is an ordinance on non -storm water <br />discharges into the MS4, and appropriate enforcement procedures and actions. <br />RECCOMENDATION: <br />Staff recommends discussion of the attached proposed ordinance and to make <br />recommendation on the material presented, and to be passed on to the City <br />Council for consideration. <br />ATTACHMENT: <br />1.
