<br />STORMWATER FACILITY, PRIVATE — means any BMP that is maintained by a private
<br />110 property owner, or other private entity and not maintained by a public agency.
<br />STORMWATER POLLUTION PREVENTION PLAN - means a plan for stormwater
<br />discharge that includes erosion prevention measures, sediment controls and Permanent
<br />Stormwater Management Systems that, when implemented, will decrease soil erosion on a parcel
<br />of land and decrease off -site nonpoint pollution.
<br />SURFACE WATER OR WATERS - means all streams, lakes, ponds, marshes, wetlands,
<br />reservoirs, springs, rivers, drainage systems, waterways, watercourses, and irrigation systems
<br />whether natural or artificial, public or private.
<br />UNDERGROUND WATERS - means water contained below the surface of the earth in the
<br />saturated zone including, without limitation, all waters whether under confined, unconfined, or
<br />perched conditions, in near surface unconsolidated sediment or regolith, or in rock formations
<br />deeper underground. The term ground water shall be synonymous with underground water.
<br />WATERS OF THE STATE - (as defined in Minn. Stat. §115.01, sub. 22) means all streams,
<br />lakes, ponds, marshes, watercourses, waterways, wells, springs, reservoirs, aquifers, irrigation
<br />systems, drainage systems, and all other bodies or accumulations of water, surface or
<br />underground, natural or artificial, public or private, which are contained within, flow through, or
<br />border upon the state or any portion thereof.
<br />• WATER QUANTITY BEST MANAGEMENT PRACTICE — the use of on -site runoff
<br />management practices such as biofiltration, infiltration, buffers /conservation areas, impervious
<br />disconnection, greenway connections to satisfy stormwater management requirements.
<br />WETLAND - area identified as wetland under Minnesota Statutes section 103G.005,
<br />subdivision 19.
<br />1011.05 APPLICABILITY
<br />All land disturbing activity of any size shall be subject to standard erosion and sediment
<br />control BMPs. A Grading, Erosion and Sediment Control Permit and /or a Stormwater
<br />Management Permit shall be required for projects that meet or exceed the thresholds established
<br />in Sections 1011.08 and 1011.09.
<br />1011.06 EXEMPTIONS
<br />The following land disturbing activities will be exempt from the Grading, Erosion and
<br />Sediment Control and Stormwater Management Permit requirements of this Ordinance:
<br />(1) Cemetery graves.
<br />(2) Routine agricultural activity such as tilling, planting. or harvesting of agricultural,
<br />• horticultural. or silvicultural (forestry) crops.
