• <br />• <br />CITY OF LINO LAKES <br />ORDINANCE NO. 02-03 <br />APPROVING THE VACATION OF PARK LAND, <br />PHEASANT HILLS PRESERVE 9TH ADDITION <br />WHEREAS, the City Council of the Lino Lakes has determined to vacate park land as <br />dedicated on the plat of Pheasant Hills Preserve 9th Addition; and <br />WHEREAS, a public hearing was held on January 13, 2003 before the City Council in <br />the City Hall council Chambers after due published and posted notice had been given on <br />December 31, 2002, and a reasonable attempt was made to give personal notice to all <br />affected property owners, and all persons interested were given an opportunity to be <br />heard; and <br />WHEREAS, it appears in the best interests of the City to vacate such park land; and <br />WHEREAS, four -fifths of all members of the City Council concur in this ordinance. <br />NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: <br />Section 1. The park land legally described as follows is hereby vacated: <br />All that part of the park as dedicated on the Plat of Pheasant Hills Preserve 9th <br />Addition, Anoka County, Minnesota. <br />Section 2. That any person, corporation or city owning or controlling easements <br />contained upon the property vacated reserves the right to continue maintaining the same <br />or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove <br />or otherwise attend thereto. <br />Section 3. This Ordinance shall be in full force and effect from 30 days following its <br />passage and publication, in accordance with the City Charter. <br />Passed by the Lino Lakes City Council this 27th day of January, 2003. <br />ATTEST: <br />Ann Blair, City Clerk <br />John J.
