• • CITY OF LINO LAKES ORDINANCE NO. 02-03 APPROVING THE VACATION OF PARK LAND, PHEASANT HILLS PRESERVE 9TH ADDITION WHEREAS, the City Council of the Lino Lakes has determined to vacate park land as dedicated on the plat of Pheasant Hills Preserve 9th Addition; and WHEREAS, a public hearing was held on January 13, 2003 before the City Council in the City Hall council Chambers after due published and posted notice had been given on December 31, 2002, and a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and WHEREAS, it appears in the best interests of the City to vacate such park land; and WHEREAS, four -fifths of all members of the City Council concur in this ordinance. NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: Section 1. The park land legally described as follows is hereby vacated: All that part of the park as dedicated on the Plat of Pheasant Hills Preserve 9th Addition, Anoka County, Minnesota. Section 2. That any person, corporation or city owning or controlling easements contained upon the property vacated reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto. Section 3. This Ordinance shall be in full force and effect from 30 days following its passage and publication, in accordance with the City Charter.
