• <br />• <br />• <br />STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 7B(i) <br />Michael Grochala <br />March 10, 2003 <br />Second Reading: Ordinance 06 -03 Vacating <br />Drainage and Utility Easement, Outlot A, Spirit <br />Hills <br />4/5 <br />The original plat of Spirit Hills dedicated a drainage and utility easement covering <br />an existing wetland on Outlot A. As part of the Spirit Hills Commercial <br />Development the developer is requesting vacation of the easement. The City <br />Council approved the First Reading of Ordinance 06 -03 at the February 24, 2002 <br />council meeting. <br />ANALYSIS <br />A wetland replacement plan was submitted and subsequently approved by Rice <br />Creek Watershed District to facilitate development of the site. The approved <br />grading and drainage plan /wetland mitigation plan has been implemented on the <br />site. <br />As such there is no longer a public purpose for the existing drainage and utility <br />easement. <br />RECOMMENDATION <br />Staff is recommending approval of Ordinance 06 -03 Vacating the Drainage and <br />Utility Easements on Outlot A of the recorded plat of Spirit Hills. <br />ATTACHMENTS <br />1.
