MEETING DATE: TOPIC: VOTE REQUIRED: BACKGROUND AGENDA ITEM 7 C Jeff Smyser May 12, 2003 First Reading: Ordinance No. 11 -03 Amending Section 900 of the City Code Relating to Nuisances: Permitted Hours of Construction Activity 3/5 The City Code includes a section on nuisances, which includes restrictions on construction activity. The intent is to avoid disturbance of existing residences from construction noise during certain hours. In development agreements on new developments, we have been including a limitation on construction hours that is more restrictive than the City Code. As long as we are putting the stricter hours into the contracts, it makes sense to amend the City Code to be consistent with the practice. The restrictions would not apply to a homeowner doing work on his own home. It is not uncommon to work on a deck or a remodeling project on Sunday or evenings during the week. The intent is to limit activity that would generate more noise than a single homeowner on a home project. Note that this exception does not include building a new house. The construction of a new home is a large project that would generate significant construction noise. The following table summarizes the existing and proposed restrictions.
