CITY OF LINO LAKES <br />ORDINANCE NO. 16 -03 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF <br />LINO LAKES BY REZONING THE LAND WITHIN THE HAILEY MANOR <br />PLAT <br />FROM R RURAL TO R -1 SINGLE FAMILY RESIDENTIAL <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1: Findings <br />The City Council makes the following findings regarding the application for rezoning the <br />property described below, based on the factors listed in Section 2, Subd.1.E and 1.F. of <br />the Lino Lakes zoning ordinance: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and the official City Comprehensive Plan. Resolution 03 -140 approves <br />amending the comprehensive plan to change the land use category of the Hailey <br />Manor land to Low Density Sewered Residential and acquire more MUSA reserve for <br />the project. The ten new residential lots being created by Hailey Manor falls within <br />the annual number of new housing units (147) for 2003, in compliance with the <br />Growth Management Policy, Ordinance 01 -03. <br />2. The proposed use is or will be compatible with present and future land uses of the <br />area. Bluebill Ponds to the north and Highland Meadows West to the east both are <br />zoned R -1. The R -1 zone allows lots of 10,800 sf, which would accommodate the <br />Hailey Manor lots, and would be consistent with adjacent urbanized development. <br />3. Upon compliance with the conditions of approval set forth in Resolution 03 -140 and <br />Resolution 03 -120, the proposed use will conform with performance standards <br />contained in the zoning ordinance and other requirements. <br />4. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. Utilities are currently available to the site, <br />and compliance with Resolution 03 -140 and Resolution 03 -120 will ensure proper <br />utility service. <br />Traffic generation by the proposed use is within capabilities of streets serving the <br />property in conjunction with the public improvements proposed. The addition of 10 <br />single family homes will not overburden the roadway system. Lois Lane has outlets <br />to the east and west and Country Lane connects to 77`" St. to the south. <br />6. A public hearing was held before the Planning & Zoning Board on July 9, 2003. <br />
