• <br />• <br />ARTICLE I <br />Definitions <br />Section 1.1. Definitions. In this Agreement, unless a different meaning clearly appears <br />from the context: <br />"Act" means Minnesota Statutes, Sections 469.124 to 469.134, as amended. <br />"Agreement" means this Agreement, as the same may be from time to time modified, <br />amended, or supplemented. <br />"Authority" means the Lino Lakes Economic Development Authority. <br />"Authority Representative" means <br />"Authorizing Resolution" means the resolution of the Authority, substantially in the form of <br />the attached Schedule C to authorize the issuance of the Note. <br />"Business Subsidy Act" means Minnesota Statutes, Sections 116J.993 to 116J.995. <br />"City" means the City of Lino Lakes. <br />"Certificate of Completion" means the certification provided to the Developer, or the <br />purchaser of any part, parcel or unit of the Development Property, pursuant to Section 4.4 of this <br />Agreement. <br />"Construction Plans" means the plans, specifications, drawings and related documents on <br />the construction work to be performed by the Developer on the Development Property, including <br />the Minimum Improvements, which (a) shall be as detailed as the plans, specifications, drawings <br />and related documents which are submitted to the appropriate building officials of the City, and (b) <br />shall include at least the following: (1) site plan; (2) foundation plan; (3) basement plans; (4) floor <br />plan for each floor; (5) cross sections of each (length and width); (6) elevations (all sides); (7) <br />landscape plan; and (8) such other plans or supplements to the foregoing plans as the Authority may <br />reasonably request to allow it to ascertain the nature and quality of the proposed construction work. <br />"County" means the County of Anoka, Minnesota. <br />"Developer" means Panattoni Development Co., LLC, a California limited liability <br />company or its permitted successors and assigns. <br />"Development Property" means the real property described in Schedule A of this <br />Agreement. <br />• "Development Plan" means the Authority's Modified Development Program for <br />Development District No. 1 as modified August 11, 2003 and as it may be further modified. <br />SJB- 237079v2 <br />LN140 -81 <br />2 <br />
