• <br />• <br />• <br />STAFF ORIGNINATOR: <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 1B <br />Jean Viger, Deputy Clerk <br />November 10, 2003 <br />Consider Approving Application for Exempt <br />Permit, St. Joseph Catholic Church <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />St. Joseph Catholic Church has applied for an exempt permit to conduct a raffle at their <br />annual Venison Feed to be held on November 25, 2003. The proceeds from this <br />fundraising event will be used to award college scholarships to high school students from <br />the three school districts within the city. Non - profit organizations are allowed, under the <br />State Gambling Statutes, to apply for an exempt from gambling license if they conduct <br />fewer than five (5) gambling occasions per calendar year. St. Joseph Catholic Church <br />conducts fewer than five (5) per calendar and, therefore, remains exempt from requiring a <br />gambling license. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, require that the <br />non - profit organizations applying for the exemption permit notify the city that they are <br />applying for the exemption. The application was submitted on October 29, 2003, <br />therefore, the city will need to approve the application with no waiting period or deny the <br />application. A copy of the application is attached. <br />OPTIONS: <br />1. Adopt a motion approving the application with no waiting period. <br />2. Deny the application for exemption. <br />RECOMMENDATIONS: <br />Option No. 1 <br />
