He expressed concern regarding <br />Outlot B and creating something that might be used for commercial use. Mr. Smyser <br />advised staff does not support any commercial uses in that area. It is illegal to spot zone. <br />Ms. Carlson suggested a condition be added regarding the parcel not being used as <br />commercial. <br />Mr. Corson asked about Outlot A. Mr. Smyser advised Outlot A will be used for future <br />development. It is not unusual to leave a large property based on the future <br />Comprehensive Plan. The property could be platted as high density. The are is being <br />reserved for future development consistent with the Comprehensive Plan. <br />Acting Chair Lane asked if the developer will proceed with Highland Meadows East first. <br />Mr. Kerber stated he will proceed with Highland Meadows East first to gain access to <br />Highland Meadows. <br />Acting Chair Lane asked if the park dedication will ch if .'►' combined with the <br />outlot. Mr. Smyser stated the park dedication will ce $ 1 per new house lot. <br />Mr. Johnson stated he believes an opportunity ' s ' d to connect trails. A <br />sidewalk should be developed on the south or a. trian use and safety issues <br />because 79th Street is becoming a major e . Smyser stated the trail will come <br />down through the property and conne. o tlo r� . There is nothing else to connect to. <br />Ms. Wyland added the trail cuts <br />townhomes. Mr. Smyser advised the Park <br />Board does not f <br />ecessary. <br />Mr. Dunn asked abs the depth requirement on Lot 2 Block 2. Mr. Smyser advised that <br />if Lot 2 Block 2 is co bined into a larger Outlot B, the depth requirement will be met. <br />Mr. Johnson made a MOTION to close the public hearing at 8:30 p.m., and was <br />supported by Mr. Schilling. Motion carried 6 -0. <br />Mr. Kerber noted he will not be building on the lots. He has a builder that is interested in <br />purchasing all of the lots. <br />Mr. Johnson made a MOTION to approve the preliminary plat based on the following <br />conditions: <br />1. Lot 1 Block 2 shall be increased in depth to meet the 135 ft requirement. <br />
