Motion carried, 7 -0. <br />Mr. Dunn made a MOTION to approve the preliminary plat for The Village No. 2, with <br />the conditions presented, and was supported by Mr. Johnson. Motion carried 6 -1, with <br />Mr. Robinson voting nay. <br />E. PUBLIC HEARING, Universal Outdoor Inc., Interim Use Permit to allow <br />nine (9) advertising signs on I -35 E between Main Street and 80th Street <br />Chair Schaps declared the public hearing open at 8:11 p.m. <br />Mr. Brixius explained that Universal Outdoor Inc. is requesting approval of nine interim <br />use permits for off premise advertising signs (billboards) along I -35E. The area in <br />question is zoned R -BR, Rural Business Reserve which allows advertising signs by <br />interim use permit. He also stated that advertising signs are allowed interim uses within <br />the R -BR Zoning District and Universal Outdoor Inc. has substantially complied with the <br />City regulations governing advertising signage. <br />Staff recommended approval of the interim use permits for off premise advertising signs, <br />subject to the following conditions: <br />1. Applicant identify the homes nearest to the proposed sign sites and <br />demonstrate compliance with the 750 foot setback. <br />2. Applicant demonstrated that Sign No. 1 meets the 1,200 foot setback <br />requirements from the adjoining GB District. <br />3. A separate interim use permit for each affected property. Their permit <br />outlined that the signs shall be removed if the site is rezoned or <br />redeveloped to add another principal use. Sign removal shall be the <br />responsibility of the property owner and the applicant. Both the <br />property owner and the applicant shall sign the approved interim use <br />permit. <br />4. In light of the anticipated land use planning along I -35E, we would <br />ask the applicant to reconsider the location and construction of Signs <br />1 and 2. <br />5. Sign construction plans be subject to review and approval of the City <br />Building Inspector. <br />6. Applicant provide the City with copies of approved off - premise <br />advertising device permits from MnDOT. <br />• <br />
