• <br />• <br />• <br />Planning & Zoning Board <br />July 9, 1997 <br />Page 3 <br />Mr. Robinson made a MOTION to continue the public hearing for the Rehbein <br />Arena /BMX Bike Racing proposal to the August 13, 1997 Planning & Zoning <br />Board meeting. He was supported by Ms. Dahl. Motion carried unanimously. <br />B. Continuation of Public Hearing, Liza Horner /Lisa Erhardt, 1565 Holly <br />Drive East, Amended Conditional Use Permit <br />Ms. Wyland stated that at the last meeting, the Board continued this public <br />hearing in order for staff to review the City ordinance pertaining to efficiency <br />apartment regulations. At this time efficiency apartments are only located in <br />multi - family districts. The minimum size requirement is 690 square feet. This <br />property is zoned rural. Commercial horse breeding is allowed by a Conditional <br />Use Permit. Staff believes this application to allow living quarters should be <br />considered as an customary and incidental use to the horse boarding operation <br />guided by the State Building Code as far as size is concerned. The State <br />Building Code minimum size requirement is 220 square feet with a separate <br />bathroom. The application is for an efficiency unit of 657 square feet, which <br />would meet State Building Code requirements. The Fire Chief has stated that it <br />would be dangerous to allow another use, such as living quarters, unless the <br />building is brought up to code. At a minimum, he has recommended that hard <br />wired, interconnected smoke alarms be installed throughout the buildings. He <br />has also recommended that the living unit be restricted to owners and or <br />employees only and not offered for rent to the general public. <br />Chair Schaps declared the public hearing reopened at 6:56 p.m. There were no <br />public comments. <br />Mr. Robinson made a MOTION to close the public hearing at 6:57 p.m. and was <br />supported by Mr. Dunn. Motion carried unanimously, 5 -0. <br />Mr. Dunn recommended adding condition No. 8 to require battery operated <br />smoke alarms also for dual protection. He also recommended requiring <br />installation of steel doors and double sheet rock walls to act as fire barriers. <br />Ms. Wyland responded that the steel doors and double sheet rock is part of the <br />building code, and the application must meet those conditions as part of the <br />building permit requirements. Therefore, they need not be a separate condition. <br />Mr. Wessel stated that he would be hesitant to begin adding building code <br />conditions that become unwieldy. Construction code standards are the <br />responsibility of the Building Official. <br />
