All trash handling equipment is screened from view of adjacent properties and <br />public right -of -way by a fence or wall at least six feet in height with a maximum <br />opaqueness of 80 percent. <br />11. A grading and drainage plan is submitted. Such plan shall be subject to review <br />and approval by the City Engineer. <br />12. Elevations of the proposed canopy and car wash are submitted and subject to City <br />review and approval. <br />13. The site plan is modified to identify exterior lighting locations. All exterior <br />lighting shall be hooded and directed such that the source of the light is not visible <br />from any adjacent residential properties or public rights -of -way. <br />14. All applicable MPCA requirements are satisfied in regard to the bulk storage of <br />fuel. <br />15. Detailed sign plans are submitted. All site signage shall comply with applicable <br />provisions of the City's Sign Ordinance. <br />16. Comments of other City staff. <br />Motion carried unanimously, 7 -0. <br />G. John Johnson, 6657 East Shadow Lake Drive - Variance <br />Ms. Wyland stated that Mr. Johnson is requesting to build an addition to his home that <br />would be 46 feet from the Ordinary High Watermark (OHW). The house is currently 60 <br />feet form the OHW. The City's Shoreland Management Ordinance requires a 75 -foot <br />setback from the OHW on a Recreational Development Lake that is sewered, such as <br />Reshanau Lake. The Shoreland Ordinance also takes into consideration whether: 1) the <br />property is used seasonally or year- round; and 2) the characteristics of development on <br />adjacent properties. This is year -round residence, and adjacent properties range from 60 <br />feet from the OHW to 25 feet from the OHW and one deck 15 feet from the OHW. DNR <br />officials indicated that generally an average of the setback of adjacent properties is used, <br />which would be 40 feet in this case. Staff believes there is justification for granting the <br />variance and recommends approval, subject to obtaining the proper permits. No <br />objections from neighbors have been received regarding the proposed expansion. <br />Mr. Robinson made a MOTION to grant the 46 -foot variance to the Ordinary High <br />Watermark at 6657 East Shadow Lake Drive, subject to obtaining the proper permits and <br />was supported by Mr. Herr. Motion carried unanimously, 7 -0. <br />F. Lino Elementary School, 725 Main Street - Variance and Site Plan Review <br />Ms. Wyland stated that the Lino Elementary School has requested a variance to allow <br />construction of a larger parking area to accommodate 135 to 145 cars and bus lane in <br />front of the school that would be 10 feet from the front property line. The City ordinance <br />requirement is a 15 -foot setback which would allow 117 to 127 cars. However, the <br />minimum parking requirement for a facility this size is 201 spaces. Staff recognizes this <br />expansion need and would recommend approval of the site plan. However, staff would <br />recommend denial of the variance because it does not fulfill the criteria for a variance as <br />stated in the City Code. <br />• <br />• <br />• <br />
