Ms. Wyland presented the following background for this item: American Legion <br />Post 5466 is requesting a Conditional Use Permit and Site Plan Review for the <br />property located at 415 Lilac Street. The site is zoned General Industrial (GI) and, <br />according to the Zoning Ordinance, Section 8, Subd. 2F Permitted Uses include <br />any use listed as a permitted use in the Commercial District and Light Industrial <br />District that will not interfere with the proper development of the General <br />Industrial District. In Section 7, Subd. 2, LB, Limited Business, H. Conditional <br />Uses, include 1. Private lodges and clubs. <br />Should the Planning and Zoning Board decide that this use "will not interfere with the <br />proper development of a General Industrial District ", the above - mentioned sections of the <br />Ordinance do allow this use via a conditional use permit. <br />Planning Coordinator Wyland reviewed the staff report which recommend approval of this <br />Conditional Use Permit and Site Plan Review with the following conditions: <br />1. Proper building permits prior to any construction. The building permit shall <br />include a 1% escrow for site improvements including paving of the parking area <br />and access drives, and site landscaping. In lieu of a cash escrow, a letter of credit <br />may be submitted. <br />2. Sewer and water utilities shall be connected to the building prior to issuance of a <br />certificate of occupancy. The applicant shall also agree to be assessed for said <br />utilities at a rate to be determined by the City Engineer. <br />3. The parking area and access drive shall be surfaced with bituminous and concrete <br />curb and gutter provided per City standards. This surfacing shall be completed <br />prior to occupancy of the new addition. If the addition is not constructed within <br />12 months, the surfacing shall be completed at that time. <br />4. Any change in the submitted site plan shall require a new review by the City <br />Council. <br />5. The trash handling area shall be screened from adjacent properties. <br />6. Parking shall be provided for 32 vehicles as well as handicapped spaces according <br />to ADA Rules and Regulations. <br />7. A landscaping plan shall be supplied indicating plantings on the north, east and <br />west sides of the building. The plan shall be subject to the review and approval of <br />the City Forester. <br />8. The CPTED Officer shall review and approve the lighting plan. <br />9. Construction shall be initiated within 6 months of the date of this approval and <br />completed within 18 months. <br />10. Other conditions as suggested by the Board. <br />
