PLANNING AND ZONING BOARD AUGUST 17, 1988 <br />Section 6 Subdivision 15 (2) (C) of the Zoning <br />Ordinance. <br />For the rear setback - The setback that is required <br />is 30 feet and what is on the plan is 10 feet. <br />Section 6 Subdivison 15 (2) (C) (VI) setback on the <br />side from a residential area ahich requires a 35 foot <br />setback and we have a 20 foot setback on the plan. <br />Section 8 (1) (C) (i) (b) (a) which requires when you <br />have 8,000 square feet in an area such as this that <br />you have 47 parking spaces. On the plan they have 34 <br />parking spaces listed. <br />Section 8 (2) (D) parking areas the requirement is <br />they should be 15 feet from the road right of way. <br />On this plan they are 5 feet from the right of way. <br />Section 8 (4) (A) driveway maximum width would be <br />26 feet. On this plan it is 30 feet. <br />Chairman Cody recommends a variance on all of these issues <br />based on subdivision 7 of the ordinance if particular sub <br />paragraphs 1 -6. In this particular case: <br />1. The property can't be put to a reasonable use <br />under the conditions allowed by our zoning <br />ordinances exist. <br />2. The landowner - due to circumstances unique <br />to this property and they haven't been created <br />solely by the land owner. <br />3. The hardship is not due to economic conditions <br />alone. <br />4. The granting of the variance isn't going to confer <br />this applicant any special privledge - it would <br />be denied by the ordinance to the lands in the <br />same zoning district. <br />5. The actions taken won't diminish the established <br />property values within the neighborhood. <br />6. The proposed actions will be in keeping with the <br />spirit intent of the ordinance. <br />PAGE 5 <br />
