• <br />• <br />• <br />PLANNING & ZONING BOARD <br />February 9, 1987 <br />Page Two <br />MINOR SUBDIVISION - DONALD McSHANNOCK <br />Mr. McShannock (property owner) and Mr. Goertz (prospective buyer) <br />represented this application to split a 10 -acre parcel into two <br />5 -acre parcels. The parcel is a strip which runs from Hodgson Road <br />(330 foot frontage) to Ware Road (330 foot frontage). Mr. Goertz <br />plans to build a single- family home on the tract fronting Ware <br />Road and make arrangements to hook up to utilities which may possibly <br />be extended to this area from the Shoreview system. <br />Mrs. Nelson said that she had reservations with this application for <br />several reasons: The property is largely within Zone A on the Flood <br />Plain map; this may not only impede extension of utilities, but also <br />Mrs. Nelson understood that utilities which run through a flood zone <br />cannot be assessed in the usual manner. Another concern was that <br />the driveway to the proposed homesite would also be in the flood zone. <br />The Board also questioned whether there is one acre of buildable <br />property on the newly - created parcel (as required by ordinance). <br />Mr. Kluegel assured the Board that in his opinion at least one acre <br />of buildable land exists; the DNR may have to address this situation; <br />City Council may have to grant a variance for the driveway. <br />The point was brought up that the P & Z Board is only dealing with <br />a minor subdivision request with this application by Mr. McShannock. <br />The questions with regard to building, driveway, utilities need not <br />be considered in order to approve the subdivision. <br />MOTION: Mrs. Averbeck moved to recommend to Council approval of <br />application 87 -2 from Donald McShannock (dated 2/11/87) for a minor <br />subdivision based on the fact that it meets the basic requirements <br />of 5 acres minimum in this zone, 330' frontage, and one acre minimum <br />buildable land. Mr. Prokop seconded the motion which carried with <br />Mrs. Nelson voting no. <br />MINOR SUBDIVISION - VERNON WAHLBERG <br />Mr. Kluegel explained that a prospective buyer wishes to obtain <br />a mortgage on only the house and one of the five acres in this <br />parcel. The applicant is requesting splitting the one acre where <br />the house is located from the other four acres. Apparently the <br />reason this is necessary is that the lending institution needs a <br />separate legal description. <br />The property in question is a nonconforming use (residential in a <br />GB zone). Mr. Johnson voiced his concern that approving this <br />request may be "intensifying" a nonconforming use, which is <br />
