Planning and Zoning <br />January 21, /981 <br />ire Two <br />Mr. Schumacher reminded the Board of the requirements that had been set <br />forth by the City Planner. <br />Mr. Acton pointed out that he has no plans to develop this land, he is askin <br />for the rezone for the purpose of allowing the construction of bill boards <br />on the property. <br />Mr. Schumacher reported that he had taked to the person at the MNDOT who <br />is concerned with sign permits for bill boards and was told that if the <br />property is being rezoned specifically for the purpose of constructing <br />bill boards, the State would not issue permits. <br />Mr. Schumacher had investigated the possibility of a variance for the <br />construction of the bill boards and this is not allowed. Mr. Schumacher <br />said the only action would be to consider this rezoning request as outlined <br />by Mr. Short. <br />Mr. Acton said that he had talked to someone at the State and had been in- <br />formed that there are rules against strip zoning along a freeway for the <br />purpose of installing bill board. He felt confident that in this case, if <br />the entire parcel was rezoned, there would be no problems - the area to the <br />West is zoned commercial as is the land East of the freeway. He said he <br />has no plans for the development of this land, will probably hold until <br />sewers are available and then sell. He pointed out that in the Comprehensiv <br />n, this area is suggested for Industrial zoning. <br />Mr. Bae7hke said he could understand Mr. Acton's position but he reminded <br />him that this Board is responsible for good planning and all requiremnts <br />for the rezone is correct before forwarding a recommendation to the Council. <br />In the absence of the items suggested by Mr. Short, there is no way to <br />consider this rezone application. <br />There was some discusion on the time table for approval of the Comprehensive <br />Plan and some possible requirements that could be imposed by Metropolitan <br />Council. <br />Mr. Prokop moved to recommend to the Council this rezone application be <br />considered in that i7 is consistent with the Comprehensive Plan dated <br />May 1980. Seconded by Mr. Heath. Mr. Doocy asked if just this parcel of <br />land is being considered and was told yes. Mr. Schumacher asked if any of <br />the Planner's recommendations would be part of the conditions for rezoning <br />and Mr. Prokop felt this should be rezoned first. Motion carried <br />unanimously. <br />Mr. Brian Barrot had applied for a variance to the moratorium that does not <br />allow the splitting of lands by metes and bounds. He is asking to transfer <br />title of a parcel of land of 2L.Aasres on Birch St. Mr. Barrot has purchased <br />one of the homes in the County"Park property to move onto this parcel of <br />land. <br />Kluegel reported the house had been thoroughly checked in 1978 and the <br />plumbing and electircal service is up to code. <br />There was some discussion on the ordinace creating the moratorium and the <br />
