MINNESOTA 55303 <br />PHONE (612) 427 -8877 <br />FAX (612) 421 -4213 <br />You have asked for our analysis of the proposed use of park dedication fees and trail <br />dedication fees in the City of Andover. We have reviewed the applicable statute and <br />case law and would ask that you consider the following information. <br />The current situation is as follows: the City imposes a park dedication of 10% for new <br />plats. The developer is asked to dedicate either 10% of the land or an amount in cash <br />equivalent to 10% of the value of the land. Developers are directed to choose from a <br />panel of appraisers and pay an amount based upon that appraisal. The City is <br />considering a change in the park dedication fee from a percentage calculation to a per <br />unit charge. The proposed charges are as 'follows: <br />Type Amount <br />Single Family $1,350 <br />Townhouse $ 1,000 <br />Mobile Home $ 1,200 <br />Lot Splits $1,350 <br />Commercial $4,000 (acre) <br />In the typical residential urban zoning district, we would expect to see two Tots or <br />units per acre. Consequently, under the new unit charge system, the unit charge per <br />acre would be S2,700. I understand that an acre of land in the City of Andover <br />suitable for a residential development would typically sell for $ 13,000. <br />The City is also considering the imposition of a trail dedication fee. This fee was <br />imposed previously but discontinued some months ago. The City is contemplating the <br />renewed use of this fee. It is anticipated that the fee would be imposed at the rate of <br />$250 per unit payable at the time of the issuance of a building permit. Additionally, <br />EXHIBIT A <br />
