• <br />Lino Lakes Parks and Recreation Department <br />600 Town Center Parkway <br />Lino Lakes, MN 55014 <br />(651) 982 -2440 Fax (651) 982 -2439 <br />• <br />• <br />July 24, 2001 <br />TO: Park Board Members <br />FROM: Rick DeGardner, Public Services Director <br />SUBJECT: Review Possible Condemnation Cost for Birch Park Trail <br />After extensive discussion at the July 2 Park Board Meeting city staff was directed to investigate <br />the cost of condemnation and the impact on the remaining property. <br />Discussions with the city attorney indicate approximate legal fees for a commission hearing of <br />$15,000. If the award is appealed and subsequently assigned to a jury trial, legal fees could <br />double to approximately $30,000. Obviously, this is in addition to any cash awards to the <br />existing property owners. <br />Staff was also directed to determine the impact on the remaining property.
