(1) <br />(2) <br />Persons wishing to initiate an amendment shall fill out a "Zoning Form" and be <br />accompanied by a fee as required in Section 9 of this ordinance to be used for the costs <br />of processing the application. The Zoning Form shall be filed with the zoning official. <br />Property owners or occupants within three hundred fifty (350) feet of any property <br />proposed for zoning district amendment (rezoning) shall be notified in writing, although <br />failure by any property owner to receive such notification shall not invalidate the <br />proceedings. Notification shall be by registered mail. <br />(3) All requests for amendments shall be referred to the planning commission for review and <br />recommendation to city council. <br />(4) Site and building plans consistent with the requirements established in Section 5, Subd. 4 <br />shall be provided prior to planning commission review. This requirement may be <br />waived if rezoning can be accommodated without review of a specific proposal. <br />(5) Upon review of the application, the planning commission shall make a report and <br />recommendation to the city council. <br />(6) A public hearing on the rezoning application shall be held by the planning commission <br />or council. <br />(7) Notice for the purpose, time and place of such public hearing shall be published in the <br />official newspaper of the city and mailed to the appropriate property owners at least ten <br />days prior to the public hearing. <br />(8) The city council must take action on the application within sixty (60) days following <br />referral by the planning commission. The person making the application shall be <br />notified of the action taken. Such action may consist of approval, denial, or referral back <br />to the planning commission. Any action should be accompanied with reasons for action <br />taken. <br />(9) <br />No application for rezoning which has been denied shall be resubmitted for a period of <br />twelve (12) months from the date of said order of denial unless all reasons for denial, as <br />outlined by the city council, have been satisfied. <br />
