All builders in new housing projects shall submit a tree <br />protection plan to the City to be reviewed as part of their <br />normal building permit procedure. This plan must be approved <br />by the City Forester or Assistant in accordance with the <br />standards and specifications for tree care section of this <br />Ordinance, and physical barriers installed before any <br />construction of said building or house proceeds. The tree <br />protection plan much cover all areas of preventing <br />construction dama7e including the designation of utility <br />alleys, cut and fill areas, tree felling, tree wounding, tree <br />protection zones, and disease control, and any other areas <br />thought to be necessary by the City Forester. No person <br />shall deposit, place, store, or maintain upon any public <br />place of the municipality, any stone, brick, sand, concrete, <br />or other materials which may impede the free passage of <br />water, air, fertilizer to the roots of any tree growing <br />therein, except by written permit of the Municipal Forester. <br />All development subdivisions must submit a tree preservation <br />plan in accordance with the City of Lino Lakes Tree <br />Preservation Policy adopted by the City. <br />All new building project sites must submit a tree <br />preservation plan in accordance with the Tree Preservation <br />Policy adopted by the City. <br />1007.16 VIOLATION AND PENALTY <br />Any person violating any provisions of this ordinance shall <br />be guilty of a misdemeanor. <br />1007.17 LEGALITY OF ORDINANCE AND PARTS THEREOF <br />Should any section, clause, or provisions of this Ordinance <br />be declared by the Courts to be invalid, the same shall not <br />affect the validity of the Ordinance as a whole, or parts <br />thereof, other than the part so declared to be invalid. <br />1007.18 EMERGENCY <br />This Ordinance is <br />necessity for the <br />safety, and shall <br />after its passage <br />hereby declared to be of immediate <br />preservation of public peace, health, and <br />be in full force and effective from and <br />and publication as provided by law. <br />Page 7 <br />
