MRR -23 -2000 10:18 <br />b01 e e 17bb3 r.10D/11 <br />REVIEW DRAFT <br />0323/00 <br />■ Utility construction (i.e. sewer, water, storm sewer, gas, electirc, telephone and cable <br />TV and trenching) resulting in the cutting of thirty (30) percent or more of a <br />significant tree's roots within its critical root zone; <br />■ Mechanical injury to the trunk of a significant tree causing wounds or loss of bark, <br />which may result in tree decline; <br />• Compaction of thirty (30) percent or more of the surface of the soil within a <br />significant tree's critical root zone. This includes compaction caused by vehicle <br />movement, material storage, or similar actions; <br />■ The complete removal of a tree. <br />III. APPLICABILITY <br />A. Tree Preservation Plan Required: <br />1. A Tree Preservation Plan as described in Section IV herein, shall be reviewed and <br />approved by the City Council in conjunction with all applications for: <br />• Preliminary Plat <br />• Planned Development Overlay (PDO) <br />• Site and Building Plan Review <br />• Earth moving and land reclamation or other land disturbing activity <br />2. On individual single - family lots, a Tree Preservation Plan, as described in Section IV <br />herein, shall be submitted for review and comrnent by City staff in conjunction with a <br />building permit application. [process may need to be clarified] <br />B. Plan Review Process: <br />1. The applicant shall meet with City staff prior to submission of a Tree Preservation <br />Plan to determine the most feasible and practical placement of buildings, parking, <br />driveways, streets, storage and other physical features, in order to minimize loss and <br />damage to significant trees and woodlands. <br />2. Upon submittal, the City staff will review the Tree Preservation Plan to evaluate <br />compliance with the regulations and standards herein. City staff will notify the <br />applicant of any deficiencies with the plan or if additional information is needed to <br />complete the evaluation. <br />3. For any project that requires a Tree Preservation Plan, the City will make a <br />determination that the Tree Preservation Plan is acceptable for implementation prior <br />to issuance of any permits. <br />C. Performance Security Required: The applicant shall provide security for the <br />performance of its obligations pursuant to this section following City approval of the <br />Tree Preservation Plan and prior to commencement of any land disturbing activity as <br />follows: <br />4 <br />
