Subp. 38. Public value of wetlands. "Public value of <br />wetlands" means the public benefit and use of wetlands for water <br />quality, floodwater retention, public recreation, commercial <br />uses, and other public uses. <br />Subp. 39. Public waters wetlands. "Public waters <br />wetlands" means all types 3, 4, and 5 wetlands, as defined in <br />United States Fish and Wildlife Service Circular No. 39 (1971 <br />edition), that were inventoried by the department as public <br />waters under Minnesota Statutes, section 103G.201. <br />Subp. 40. Replacement wetland. "Replacement wetland" <br />means a wetland restored or created to replace public values <br />lost at an impacted wetland. <br />Subp. 41. Restoration. "Restoration" means <br />reestablishment of an area that was historically wetlands but <br />currently provides no or minimal wetland functions due to <br />manmade alteration such as filling or drainage. <br />Subp. 42. Right -of -way acreage. "Right -of -way acreage" <br />has the meaning given it in Minnesota Statutes, section <br />103E.285, subdivision 6. <br />Subp. 43. Riverine wetland. "Riverine wetland" means a <br />wetland contained within the banks of a channel that may contain <br />moving water or that forms a connecting link between two bodies <br />of standing water. <br />Subp. 44. Set aside. "Set aside" means the cropland <br />acreage annually retired as a condition to landowner <br />participation in United States Department of Agriculture <br />commodity programs. <br />Subp. 45. Silviculture. "Silviculture" means the <br />scientific management of forest trees. <br />Subp. 46. Soil and water conservation district. "Soil and <br />water conservation district" means a legal subdivision of state <br />government under Minnesota Statutes, chapter 103C. <br />Subp. 47. Soil Conservation Service. "Soil Conservation <br />Service" means an agency of the United States Department of <br />Agriculture. <br />Subp. 48. Tributary wetland. "Tributary wetland " - means -a <br />wetland with a well defined outlet, including tile systems, <br />ditches, or natural watercourses, but without a well defined <br />inlet. <br />Subp. 49. Utility. "Utility" means a sanitary sewer, <br />storm sewer, potable water distribution, and transmission, <br />distribution, or furnishing, at wholesale or retail, of natural <br />or manufactured gas, electricity, telephone, or radio service or <br />communications. <br />Subp. 50. Watershed. "Watershed" means the 81 major <br />watershed units delineated by the map "State of Minnesota <br />Watershed Boundaries — 1979" as produced by the Minnesota <br />Department of Natural Resources, Office of Planning and <br />Research, Water Policy Planning Program, with funding from the <br />Legislative Commission on Minnesota Resources. <br />7 <br />
