agency, or organization that is the owner of credits. <br />Subp. 4. Applicant. "Applicant" is a person, corporation, <br />government agency, or organization that makes an application to <br />withdraw wetland credits from the wetland bank. <br />Subp. 5. Credits or wetland credits. "Credits" or <br />"wetland credits" means acres or parts of acres of restored or <br />created wetland, catalogued by abbreviated Cowardin, et al. <br />wetland type from part 8420.0540, subpart 10, item B, and inlet <br />and outlet characteristics deposited in the wetland bank. <br />Subp. 6. State wetland banking system, wetland bank, or <br />bank. "State wetland banking system," "wetland bank," or "bank" <br />means a system of identifying wetlands restored or created for <br />replacement credit, providing for, and facilitating and tracking <br />the exchange of wetland credits for projects that require <br />replacement plans. <br />SA: MS s 14.06; 103B.101; 103B.3355 <br />HIST: 18 SR 274 <br />8420.0720 PRINCIPLES OF WETLAND BANKING. <br />Subpart 1. Goal. Implementation of a wetland banking <br />system must comply with the purposes and goals of the act by <br />achieving a no -net loss in the quantity, quality, and biological <br />diversity of Minnesota's existing wetlands. <br />Subp. 2. Sequencing prerequisite. The state wetland <br />banking system may only be used for replacement of drained or <br />filled wetlands when the local government unit determines that <br />the applicant has complied with all of the sequencing <br />requirements of part 8420.0520; that the project would otherwise <br />be allowed if adequate replacement could be secured by the <br />applicant; that project- specific replacement is not reasonable <br />or desirable; and that the owner of the account agrees to the <br />withdrawal of credits from the account. <br />Subp. 3. Geographic limitations. In counties having <br />greater than 80 percent of their presettlement wetlands intact, <br />wetland banking is allowed for any impact. Wetland banking in <br />counties with less than 80 percent of their presettlement <br />wetlands intact can be considered only in situations involving <br />impacts of less than five acres, except in certain circumstances <br />as noted in part 8420.0740, subpart 2, item B, subitem (2). <br />Subp. 4. Eligible wetlands. Restored wetlands are <br />eligible for deposit into the wetland bank. Created wetlands <br />are eligible for deposit in the wetland bank in counties in <br />which 80 percent or more of the presettlement wetlands are <br />intact. In other counties, created wetlands are eligible for <br />deposit in the bank only if they are created by excavation in <br />nonwetlands, by dikes or dams along public or private drainage <br />ditches, or by dikes or dams associated with the restoration of <br />previously drained or filled wetlands.
