Agenda Item 6A <br />Environmental Board Meeting Date: December 19, 2001 <br />Topic: <br />Summary: <br />Interim Ordinance Prohibiting Residential Development <br />Zoning /Subdivision Ordinance Update Process <br />The City is in the process of considering adoption of an Interim Ordinance <br />prohibiting new residential preliminary plats, residential rezoning, and allocating <br />MSUA reserve for new residential development. The purpose of the Interim <br />Ordinance, often called a "Moratorium" is to provide the city with an opportunity <br />to update its zoning and subdivision ordinances to implement the goals and <br />policies of the Comprehensive Plan. <br />The Interim Ordinance does not apply to the following: <br />1. Final Platting of approved preliminary plats <br />2. Development within the "Village" area <br />3. Minor subdivisions or plats resulting in the creation of four or fewer Tots, <br />provided that said subdivisions are within the existing MUSA <br />4. Commercial and Industrial development <br />5. Building Permits and Site Plan Reviews <br />The Planning and Zoning Board reviewed the proposed Interim Ordinance and <br />held a public hearing on December 12, 2001 and recommended approval of the <br />ordinance. The City Council will be considering approval of the First Reading of <br />the ordinance at the December 17, 2001 council meeting. Consideration of the <br />Second Reading is scheduled for January 14, 2002. If approved, the ordinance <br />will be published and go into effect on February 21, 2002 for a period of one <br />year. <br />Both the City Council and the Planning and Zoning Board emphasized the need <br />to complete the necessary ordinance revisions within the one year timeline. It is <br />important to note that the update of the ordinances will be based on the policies <br />setforth in the Comprehensive Plan. The process will not involve revisiting <br />issues within the plan itself. The process will involve examining the policies <br />setforth in the plan and developing a means to carry them out. This must be <br />understood clearly from the start to insure completion of the updates in a timely <br />manner. <br />To facilitate this process the council will establish a task force comprised of two <br />members each from the Environmental Board, Planning & Zoning Board, and <br />Economic Development Advisory Committee.
