• <br />• <br />Agenda Item 5A <br />Environmental Board Meeting Date: January 21, 2004 <br />Topic: Record of Decision for Legacy at Wood's Edge Development, Findings of <br />Fact and Conclusion. <br />Background: The City of Lino Lakes and the Hartford Group applied on <br />November 10, 2003 to seek approval for mixed -use development with residential <br />and commercial buildings. A mandatory EAW was performed and reviewed by <br />the Environmental Board on November 6, 2003. Comments from this review are <br />recorded. Comments from the EAW distribution list have been received. <br />Short Elliot Hendrickson Inc., has prepared a Record of Decision document. The <br />Findings of Fact and Conclusions section of this document contains the <br />distribution list comments and the City's response to the comments. <br />Analysis: City responses to review comments address the concerns of <br />contributing agencies. Conclusions of the report state: <br />• All requirements for environmental review have been met. <br />• The EAW and the permit processes related to the project have <br />generated information that is adequate to determine whether the <br />project has the potential for significant environmental effects. <br />• Mitigation will be provided where impacts are expected to result from <br />project construction and operation of the site. Mitigation measures are <br />incorporated into the site plan, and have or will be incorporated with <br />state and local agencies during the permit process. <br />• Based on criteria in Minnesota Rules 4410, the project does not have <br />the potential for significant environmental effects. <br />Based on the findings of facts and conclusions, indications strongly deny the <br />need for an Environmental Impact Statement study, and strongly supports a <br />negative impact declaration for the Legacy at Wood's Edge Development project. <br />Recommendation: <br />Negative Declaration <br />Attachments: <br />1.
