The Technical Evaluation Panel makes recommendations <br />to the Rice Creek Watershed District but the Rice Creek Watershed District has the final authority <br />to accept or deny a wetland replacement plan. <br />Since a functional assessment has not been submitted and alternatives exists that would avoid <br />impacts to the wetlands and meet all the requirements outlined in Minnesota Rules 8420.0548 <br />Subp 3C2, the Rice Creek Watershed District Staff will recommend that the Rice Creek <br />Watershed District Board of Managers deny your wetland replacement plan at the Board Meeting <br />held on April 28, 2004, 7:00 p.m. at the Shoreview City Hall. <br />If you wish to submit a functional assessment you may either write me a letter requesting an <br />extension on the decision date until the assessment is complete or you can submit a new <br />application when the assessment is complete. If a letter requesting an extension on the decision <br />date is received before April 19, 2004, the recommendation for denial of the wetland replacement <br />plan will not be presented to the Board of Managers at the April 28, 2004 meeting. The Rice <br />Creek Watershed District is administratively extending the decision period until April 29th, 2004 <br />allow you time to submit any additional information. <br />I would be willing to meet with you and your engineer to discuss possible changes to your plan <br />that would conform to the Wetland Conservation Act and allow the Rice Creek Watershed <br />District to approve the plan.
