• <br />• <br />for Wards Lake is 883.7. The overlay zone and the shoreland setbacks within it are measured <br />from this elevation. The entire project area is within the shoreland district. <br />City ordinance regulates uses in the overlay district to protect and conserve the natural values <br />of land adjacent to surface waters and related land resources. The shoreland ordinance <br />classifies Wards Lake as a "natural environment" lake. <br />A shoreland overlay allows the uses allowed by the underlying zoning. The project proposal <br />includes rezoning the site for a single family planned development, which would allow single <br />family dwellings. <br />The following requirements of the shoreland ordinance are of particular interest for the <br />proposed project: <br />minimum lot area <br />minimum lot width <br />minimum OHWL setback <br />20,000 sf <br />80 feet (measured at both street and OHWL setbacks) <br />150 feet <br />Section 1102.09, Subd. 3.B. of the ordinance states: "Roads, driveways, and parking <br />areas must meet structure setbacks and must not be placed within shore impact zones <br />when other reasonable and feasible placement alternatives exist. If no alternatives exist, <br />they may be placed within these areas, and must be designed to minimize adverse <br />impacts." (The shore impact zone is one -half the setback, or 75 feet.) <br />Although the proposed project does meet the lot area and width requirements, it does not <br />meet the requirements for setbacks because the island is less than 300 feet wide. Because of <br />this and other normal zoning and development requirements that cannot be met, a planned <br />unit development (PUD) has been proposed. A PUD is not simply a way to avoid <br />development ordinance standards. A PUD offers the opportunity to deviate from strict <br />application of ordinance requirements to achieve goals —such as more efficient use of land <br />and preservation of desirable site characteristics that would not be possible when adhering <br />to normal ordinance requirements. <br />The proposed eight lot subdivision would be located only on the upland area with homes <br />setback to the greatest extent possible from the ordinary high water level. Stormwater runoff <br />from the homes and street will be diverted into swales and ponds, providing for infiltration, <br />overland filtration, or treatment in the ponds (see Items 12, 16 and 17). The developer <br />proposes custom grading of lots to maximize tree preservation and minimize site disturbance. <br />Item 27 includes additional discussion of zoning ordinance requirements and the PUD. <br />Floodplain: The city has a floodplain management ordinance. Around Wards Lake, <br />the 100 -year flood elevation, which defines the floodplain, is 887.6. This includes the edges <br />of the island and the peninsula.
