• Agenda Item 5A <br />Environmental Board Meeting Date: July 15, 2004 <br />Topic: EAW Review /Responses to Comments /Pheasant Hills Preserve 12 <br />Background: The Lino Lakes Environmental Board reviewed PHP 12 EAW on <br />July 30, 2003. The EAW is included as Attachment 1. Environmental Board <br />comments from the meeting are included as Attachment 2. The City responses to <br />outside regulatory review comments were not available at the time of <br />Environmental Board review. In addition, the EAW was lacking relevant <br />information concerning the design, appearance, and construction concerns of the <br />bridge structure that is needed to access the island. The developer has <br />answered construction questions and submitted drawings of the proposed bridge. <br />Subsequent to these final issues addressed by the developer, City responses to <br />the PHP 12, EAW report were prepared and are included with this report as <br />Attachment 3. <br />The purpose of this agenda item is to review and comment on the City responses <br />to the regulatory comments, and make a declaration recommendation on the <br />EAW for Pheasant Hills Preserve 12th Addition. A negative declaration means, <br />that there are no findings that would imply that this project would need to proceed <br />to an Environmental Impact Statement. The Environmental Board has previously <br />recommended that this project be denied because of inconsistency with <br />statewide standards for the management of shoreland areas, or the City of Lino <br />Lakes Shoreland Management Plan. This recommendation is separate and <br />distinct from the notion of the EAW decree. <br />Analysis: Staff Response is presented in Attachment 3. <br />Options: Positive or negative declaration. <br />Recommendation: It is very rare that a project of this scope would enter <br />an environmental impact statement phase. I can see no reason to make this a <br />recommendation at this time. I believe the developer has agreed to most all of <br />the concerns and suggestions of the Environmental Board. The infiltration ponds <br />and infiltration capacity may still need to be addressed. The degree of visual <br />impacts is difficult to weigh. With that, it is a staff recommendation that a <br />negative declaration be declared. <br />. Attachments: <br />1. EAW Pheasant Hills Preserve 12 <br />
