• <br />Fox Den Acres <br />page 8 <br />RECOMMENDATION <br />Option 1, with the following conditions of approval to apply: <br />1. Grading and utility plans must obtain approval by the City Engineer prior to City <br />Council approval of the final plat. <br />2. A permit from the Rice Creek Watershed District must be obtained prior to City <br />Council approval of the final plat. <br />3. The entire project can be final platted in 2005, subject to City Council approval of <br />amendments to Ordinance 01-03. <br />4. Park dedication shall be cash with credit for construction of trails. <br />5. A homeowners association shall be created. The association shall maintain a <br />stewardship fund to manage the open space areas of Outlots A, B, and C, according to <br />a stewardship plan to be approved by the City. Association documents shall be <br />reviewed by the City Attorney prior to final plat approval. <br />6. A conservation easement shall be created over all of Outlots A, B, and C to make <br />them permanent open space. <br />7. A temporary cul de sac must be constructed on the northern stub street. <br />8. The project as redesigned must obtain a permit from the Rice Creek Watershed <br />District prior to final approval by the City Council. <br />
