• <br />• <br />Agenda Item 5A <br />Environmental Board Meeting Date: October 27, 2004 <br />Topic: Fox Den Acres /Preliminary Plat/PUD <br />Background: This proposal was reviewed at the July 28, and March 28 <br />Environmental Board Meeting. Both times a recommendation was made to look <br />at a different approach to developing this site, a Conservation Development <br />Approach. Since, July 28, staff has met with our consultant Jeff Schoenbauer of <br />Brauer and Associates, Mike Black of Royal Oaks Realty, and the Rice Creek <br />Watershed District to pursue a Conservation Development approach to the Fox <br />Den application. Timing is an issue with this project. The proposal went to the <br />October 13, 2004 P & Z for consideration. I have attached Staff Report by Jeff <br />Smyser to this report. <br />Analysis: The report presented to the P & Z lays out the issue analysis. In <br />addition, this project is geographically located at a critical point to greenway <br />establishment, on the south end of the City. To repeat previous discussions of <br />this area, Fox Den is one of our most biologically diverse sites. Conservation <br />Development of Fox Den Acres can save high quality open space in this <br />important area, It can also establish a way to successfully achieve the objectives <br />of the City Handbook For Conservation Development, The Wild Land Urban <br />Interface Project, and the recently approved Parks, Open Space and Greenway <br />Plan. If we are not able to achieve success on this site, it is doubtful that we will <br />ever be able to achieve any kind of quality success elsewhere. <br />Some details for this project were not available in time for packets. Surface <br />water treatment details will be completed shortly. Emmons & Oliver Resources is <br />working on this. The Technical Evaluation Panel still needs to approve of the <br />changes, and a stewardship program needs to be developed. <br />Planning and Zoning recommended option 1 on October 13. I would strongly <br />recommend the same. <br />Options: <br />1. Approve Fox Den Acres Conservation Development including <br />• Rezoning to residential planned unit development <br />• Preliminary Plat with conditions listed in the P & Z report, with <br />additional condition of development of an approved Stewardship Plan. <br />2. Do Not Approve <br />
