(B) Purpose. The purpose of the Monumentation Easement granted herein, and the easement <br />granted over the Outlot Easement Area, is for the initial construction by Declarant of entrance monuments to the <br />Property for the benefit of all current and future Owners of Lots and for the continuing maintenance thereof <br />after construction, and for no other purpose. <br />(C) Nonexclusive. The Monumentation Easement granted is nonexclusive, and the Owners of the <br />Easement Areas, shall have the right to use the Easement Areas to the extent such use is not inconsistent with <br />the rights declared in this Section. <br />(D) Maintenance. Continuing maintenance of the entrance monuments contained within the <br />Easement Areas and the Outlot Easement Area shall be the obligation and responsibility of the ACC. The <br />anticipated costs of such maintenance shall be included in the ACC budget prepared pursuant to Article I, <br />Section 1(E), above. <br />(E) Duration. The Monumentation Easement shall be effective upon the recording of this <br />Declaration, and shall terminate ten (10) years from the date of such recordation. <br />(F) Binding Effect. Lot 1, Block 5 and Lot 1, Block 6, above - referenced, shall specifically be <br />transferred, held, sold, conveyed and occupied subject to and together with the Monumentation Easement <br />granted herein. The Monumentation Easement, prior to its termination as referenced above, shall be binding <br />upon all parties having any right, title, or interest in the said Lots, and their respective heirs, successors and <br />assigns, and shall inure to the benefit of each Owner of Lots elsewhere within the Property, and shall run with <br />the land. <br />(G) No Alteration. During the term of this Declaration, no alteration of the entrance monuments <br />shall be effective, save and except for such maintenance as is required hereunder. <br />(H) Enforcement. Any controversy or dispute involving this Monumentation Easement shall be <br />settled by arbitration in accordance with the provisions set forth in Article V, below. <br />Section 2. Conservation Easement. Portions of the Property have been made the subject of a <br />conservation easement ( "Conservation Easement ") which has been, or will be, recorded by Declarant in favor of <br />the City of Lino Lakes. As set forth in the instrument creating the Conservation Easement, the purpose thereof <br />is to assure that those portions of the Property subject to the Conservation Easement remain in their current <br />undisturbed condition, constitute scenic surroundings, and constitute a suitable habitat for wetland vegetation <br />and/or wildlife In order to ensure that the boundaries of the Conservation Easement located on any Lot are, <br />and shall remain, identified, Declarant initially shall place sign posts or other markings as required and <br />approved by the City of Lino Lakes along the Conservation Easement boundary at locations selected and/or <br />aproved by the said City, which said sign posts or other markings shall remain undisturbed, and may not be <br />removed for any reason. Notwithstanding the foregoing, any future maintenance, repair or replacement of such <br />sign posts or other markings shall be the responsibility of the ACC. Anticipated costs of any such maintenance <br />shall be included in the ACC budget prepared pursuant to Article I, Section 1(E), above. Each Lot which is <br />subject to the Conservation Easement shall be subject to an exclusive appurtenant easement over the Lot, <br />exercisable by the ACC and its designees, for the purposes of such maintenance, repair, and replacement of sign <br />posts and other markings referenced herein. <br />Section 3. Easement for Inspection. The Property shall be subject to an exclusive appurtenant II <br />easement on and over the Lots, exercisable by or on behalf of the ACC, for purposes of inspection of <br />improvements, the construction of which has been approved by the ACC and for such other purposes <br />reasonably necessary for the ACC to fulfill or perform any responsibility or obligation otherwise contained in <br />this Declaration <br />Page 7 of 11 <br />
